1. Who we are

Vitals is operated by Byzantine Technologies LLC, based in Fairhope, Alabama, USA. You can reach us at support@fairhope.io.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use Vitals or make a purchase. By using Vitals, you represent that you meet this requirement and that any information you provide is accurate and current.

3. The product and license

Vitals consists of Microsoft Excel workbooks and supporting materials. When you download the free Lite workbook or purchase a paid edition (Pro or Coach), we grant you a limited, non-exclusive, non-transferable, revocable license for your own personal or internal business use, subject to these Terms.

We retain all right, title, and interest in and to Vitals, including all intellectual property rights. These Terms do not transfer any ownership to you.

4. Purchases, pricing, and payment

Paid editions are sold at the prices listed on the site (currently Pro $49 and Coach $129, one-time), which may change at any time. Purchases are processed by third-party payment processors — Gumroad, Etsy, or Stripe — depending on where you complete checkout. Your payment and billing information is handled by those processors under their own terms; we do not store full payment card details. You are responsible for any applicable taxes not collected by the processor.

5. Refunds

Because Vitals is a digital product delivered electronically, refunds are handled on a case-by-case basis and may also be subject to the policies of the marketplace where you purchased (Gumroad or Etsy). If something isn't working as described, contact support@fairhope.io and we'll do our best to make it right.

6. Compatibility

Built for Microsoft Excel. Desktop Excel recommended. Google Sheets, Apple Numbers, and LibreOffice are not guaranteed. Some formulas, formatting, or features may not function correctly outside desktop Microsoft Excel. We do not warrant compatibility with any other software.

7. Email and marketing

When you join our list, you agree to receive product, launch, and educational emails. You can unsubscribe at any time using the link in any email. How we handle your email and other data is described in our Privacy Policy.

8. Acceptable use

You agree not to use Vitals or this website to: violate any law; infringe anyone's rights; transmit malware or attempt to disrupt or gain unauthorized access to our systems; abuse, spam, or overload our forms or services; or misrepresent your identity. We may suspend or terminate access for any violation.

9. Not medical or nutritional advice

Vitals is an educational meal-planning and macro-tracking tool. It does not provide medical, nutritional, or professional advice, and it is not a substitute for consultation with a qualified professional. You are solely responsible for decisions you make about your diet, health, and fitness. Consult a qualified professional before making dietary changes. To the extent you use Vitals with clients (Coach Edition), you are responsible for your own professional judgment and obligations to those clients.

10. Disclaimer of warranties

Vitals is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that Vitals will be uninterrupted, error-free, secure, or that any results or outcomes will be achieved. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

To the fullest extent permitted by applicable law, in no event will Byzantine Technologies LLC or its members, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) Vitals — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability for all claims arising out of or related to Vitals will not exceed the greater of (a) the amount you paid us for the product giving rise to the claim in the twelve (12) months before the event, or (b) USD $50. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Byzantine Technologies LLC and its members, officers, employees, contractors, and agents (collectively, the "Indemnified Parties") from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or related to: (a) your use or misuse of this website, the Vitals workbooks, or any Vitals product or service; (b) your violation of these Terms, our Privacy Policy, or any applicable law or regulation; (c) information you submit to us, including any inaccurate, unauthorized, or unlawfully provided information; or (d) your infringement of any third party's rights.

This indemnification obligation survives the termination of your use of Vitals. It does not apply to the extent a claim arises from our own gross negligence or willful misconduct, and nothing in this section limits any rights you may have under mandatory consumer-protection laws that cannot be waived.

13. Third-party services and links

Vitals relies on and links to third-party services (such as Cloudflare, MailerLite, Gumroad, Etsy, and Stripe). We are not responsible for the content, policies, or practices of any third-party service, and your use of them is governed by their own terms.

14. Termination

We may suspend or terminate your access to this website or to Vitals at any time, with or without notice, for any reason, including violation of these Terms. The license granted to you ends upon termination. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or related to these Terms or Vitals will be brought exclusively in the state or federal courts located in Baldwin County, Alabama, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim in your local jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above. Your continued use of Vitals after changes take effect constitutes acceptance of the revised Terms. Material changes may be communicated by email or a notice on this site.

17. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Byzantine Technologies LLC regarding Vitals. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
